Tui Smartmenu Limited ("Tui Smartmenu", "we", "us", "our") is a New Zealand registered company providing WhatsApp booking automation services for beauty salons and service businesses. Our registered office is in Auckland, New Zealand.
By signing an onboarding agreement with Tui Smartmenu or by using any of our services, you ("the Client") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Tui Smartmenu provides the following services depending on the plan selected:
โ ๏ธ Tui Smartmenu is a service provider โ we are not responsible for the salon's bookings, cancellations, staff performance or client disputes. We provide the technology; the salon is responsible for fulfilling appointments.
Services are provided on a weekly subscription basis. Current plans are:
All prices are in New Zealand Dollars (NZD) and exclude GST unless otherwise stated. Tui Smartmenu reserves the right to update pricing with 30 days written notice.
Each plan includes a monthly allowance of support requests:
A support request includes changes to services, prices, technicians, hours or bot configuration. Unused requests do not carry over to the following month.
The Client agrees to:
All software, designs, code, dashboards, and systems developed by Tui Smartmenu remain the exclusive intellectual property of Tui Smartmenu Limited. The Client is granted a non-exclusive licence to use the service during their active subscription. Upon termination, this licence ends immediately.
The Client may not copy, reverse-engineer, resell or redistribute any part of Tui Smartmenu's technology or systems.
Tui Smartmenu's total liability to the Client shall not exceed the total fees paid in the 3 months prior to the claim. We are not liable for any indirect, incidental or consequential loss including lost bookings, lost revenue or reputational damage arising from service interruptions.
Our service relies on WhatsApp Business API (Meta) and WATI. Service availability depends on these third-party platforms. Tui Smartmenu is not liable for outages, policy changes or restrictions imposed by Meta or WATI.
These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
We may update these Terms from time to time. We will notify active clients by email at least 14 days before any material changes take effect.

All third parties are bound by their own privacy policies and data protection obligations. We do not share data with advertisers, marketers or any unrelated parties.

End users (salon clients) can opt out of receiving WhatsApp messages from the bot at any time by replying STOP to any message. Their number will be immediately removed from all future communications.
Our website (tuismartmenu.co.nz) does not use tracking cookies or analytics tools that collect personal information. We do not run advertising or retargeting campaigns.
In the event of a privacy breach that poses a serious risk of harm, we will notify affected individuals and the Office of the Privacy Commissioner as soon as practicable, in accordance with the mandatory reporting requirements of the Privacy Act 2020.
